These Terms and Conditions (“Terms”) govern your use of the iGadget website and any purchase of products from iGadget Limited (referred to as “iGadget,” “we,” “us,” or “our”). By accessing our website or placing an order, you agree to follow and be bound by these Terms. If you do not agree with any part of these Terms, please do not use our site or services. We may update or modify these Terms at any time without prior notice, so please review them periodically; continued use of the site after changes means you accept the revised Terms.

About Us: iGadget Limited is a New Zealand company (Company No. 6475832), specializing in parts and accessories for mobile phones, tablets, and laptops. All information on our site (including product listings and pricing) is provided as an invitation to  treat– in other words, it’s an invitation for you to make an offer to purchase, not a binding offer from us. We strive to ensure all information is accurate and up to date; however, occasional errors or omissions may occur. We reserve the right to correct any errors, inaccuracies, or omissions on the website (including pricing, availability, and product descriptions) and to change or update information at any time without prior notice. In the event of any conflicting information on our site, any official announcement or notice posted on the website (such as a banner message about shipping delays or holiday closures) will take precedence over other displayed details. This means if an automatic message (for example, “ships today”) conflicts with a posted announcement (e.g. “no shipping today due to a public holiday”), the announcement message will be the information that applies.

Account Registration and Responsibility

You may choose to create an account on our Website to make future purchases easier, track your orders, and access additional features. When registering, you must provide accurate, current, and complete information, and you agree to update this information as needed to keep it accurate. You are solely responsible for maintaining the confidentiality of your account login details (including your password) and for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately. iGadget will not be liable for any loss or damage arising from your failure to safeguard your account details or for any activity conducted under your account unless it is caused by our negligence. We reserve the right to suspend or terminate your account at our discretion if we reasonably believe it is being misused, used in breach of these Terms, or used for unlawful purposes.

Placing Orders and Acceptance

When you place an order with iGadget, you are making an offer to buy the selected product(s) in accordance with these Terms. All orders are subject to our acceptance. We reserve the right to accept or reject any order, in whole or in part, at our sole discretion (for example, in cases of pricing errors, stock unavailability, or suspicion of fraud). Your order is accepted (and a binding purchase contract formed) once we confirm it by email or dispatch the product to you, whichever occurs first. If we cannot supply any part of your order (e.g. an item is out of stock despite being listed), we will let you know as soon as possible and provide an option for an alternative or a refund for that item.

Order Cancellation: We reserve the right to cancel any order before it is dispatched if we discover an error in pricing or product details, or for any other reason at our discretion. If we cancel your order, we will refund any payment you have made for that order. You may request a cancellation or modification of your order by contacting us promptly; however, if the order has already been processed or shipped, we may not be able to accommodate changes. (Please refer to our Returns Policy for options if you have already received the product and wish to return or exchange it.)

Pricing and Payment

All prices listed on our website are in New Zealand Dollars (NZD) and include GST (Goods and Services Tax) unless stated otherwise. We take care to ensure pricing is correct; however, if a pricing error is identified (e.g. a product is listed at an incorrect price), we reserve the right to correct it and will contact you for instructions before processing your order at the correct price, or cancel your order and notify you of the cancellation in such cases. Prices are subject to change without notice, but any changes will not affect orders that have already been accepted and confirmed.

Payment: Payment must be made in full at the time of order checkout, using one of the payment methods we support. We accept major credit and debit cards (Visa, MasterCard, American Express, etc.), as well as popular alternative payment options like PayPal, Afterpay, POLi, and others as listed on our site. All payments are processed via secure payment gateways to protect your information. Your card or payment method will be charged at checkout for the total amount of your order, which includes product price(s) plus any applicable shipping fees (and any applicable surcharges or discounts). If there is any issue with processing your payment (for example, the transaction is declined or flagged), we may contact you to arrange an alternative payment method. Products remain the property of iGadget until full payment is received. We do not ship orders until payment has cleared.

GST Invoices: If you require a tax invoice showing GST, this will be provided with your order confirmation or can be requested from us. If you are a business customer needing ex-GST pricing or a GST invoice, please contact us prior to purchase.

Warranty

We take pride in the quality of our parts and accessories. All products sold by iGadget come with a warranty against manufacturing defects, with the warranty period depending on the type of product. We offer two standard warranty tiers for our products (as indicated on the product pages): High-Quality parts come with a 6-month warranty, and Premium parts come with a 12-month warranty. Additionally, any repair services performed by iGadget technicians (if applicable) carry a 12-month warranty on the repair. These warranty periods start from the date of purchase.

In summary, our warranties are:

  • High-Quality Products: 6-month warranty
  • Premium Products: 12-month warranty
  • Repairs by iGadget Technicians: 12-month warranty on the repair service

These warranties cover defects in manufacturing, parts, or workmanship that arise during normal use within the warranty period. For example, if a replacement screen or battery you bought from us fails due to a manufacturing fault within the covered period, we will replace or repair it at no cost to you (or refund you if a replacement is not available). 

What is not covered? Our warranty does not cover damage caused by accidents, misuse, improper installation, or other external factors not related to a manufacturing defect. (Accidental damage or issues caused by the user – such as tearing a flex cable during self-installation, physical damage from drops, liquid damage, etc. – would not be covered.) We strongly encourage you to test parts (like screens) before fully installing them, and to follow any installation guidelines, as fully installing a part that had an obvious fault can sometimes void the warranty if the installation caused further damage.

Please note that our warranty does not cover issues arising from software or firmware updates released by device manufacturers (e.g. Apple iOS, Samsung Android). From time to time, these updates may temporarily affect the functionality of third-party or replacement parts (such as displays, batteries, or other components). While such issues are outside our control, we will do our best to stay updated on compatibility developments and may provide guidance or solutions where available. However, these situations are not considered product defects and are therefore excluded from warranty coverage.

If you encounter an issue with a product within its warranty period, please contact us so we can assist. Our team may ask for details about the problem and, in some cases, ask you to perform some troubleshooting or provide photos. If the item is confirmed as faulty under warranty, we will provide a remedy – usually a replacement of the item (or a similar product of equal value) at our cost, or a refund if a replacement is not available. We will also cover the shipping costs for sending a warranty replacement or for returning the faulty item to us (we’ll provide a prepaid courier label or arrange pickup, as appropriate).

Our warranty policy is designed to give you peace of mind and is provided in addition to your rights under the Consumer Guarantees Act 1993. You can read more about the specifics (including certain product categories like batteries or accessories) on our Warranty Policy page, which is incorporated into these Terms by reference. For instance, all our batteries (which are typically classified as Premium products) also carry a 12-month warranty and are expected to hold at least 80% of their original capacity during that period. We encourage DIY repair and will honor warranties even if you install the parts yourself – as long as the part wasn’t damaged during installation due to an error (see exclusions above). Consumer Guarantees Act & Your Rights

As a New Zealand consumer, you have the protection of the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA), among other laws, which provide certain inalienable rights and guarantees. Nothing in these Terms is intended to restrict or avoid the provisions of the Consumer Guarantees Act or any other applicable consumer law, except to the extent permitted by law. This means that even if something is not explicitly covered by our Terms or policies, you still have all the rights granted by New Zealand law. For example, under the CGA, products we sell to consumers are guaranteed to be of acceptable quality, fit for their intended purpose, and match their description. If a product fails to meet any of these guarantees, you are entitled to a remedy, which could be a repair, replacement, or refund depending on the situation. We are committed to honoring our obligations under the CGA – our aim is to quickly resolve any legitimate product issues to your satisfaction.

Business Purchases: The CGA and certain provisions of the FTA (Fair Trading Act) allow businesses to contract out of these consumer guarantees in transactions where the goods are bought for use in trade (i.e., business purposes). If you are acquiring goods from iGadget for the purposes of a business (for example, you are a repair shop buying parts for resale or use in your commercial repair services), then you agree that the guarantees provided by the Consumer Guarantees Act 1993 do not apply. In other words, if you’re purchasing as a business (not as a personal consumer), the CGA’s protections are contracted out of, to the maximum extent permitted by law. This contracting-out does not apply if you are purchasing as an individual consumer for personal or household use – in that case, the CGA fully applies and nothing in our Terms will limit your CGA rights.

Aside from the above, we do not provide any additional express guarantees about products beyond what is explicitly stated in these Terms or on our website (or otherwise required by law). However, any manufacturer’s warranty or our own product warranties (as described in the Warranty section) come on top of your CGA rights – they do not replace or limit them. If you have any questions about your rights under consumer law, feel free to ask us or consult the NZ Ministry of Consumer Affairs or Citizens Advice Bureau for information.

Limitation of Liability

We strive to provide you with an excellent experience, but in the unlikely event that something goes wrong, iGadget’s liability to you is limited to the fullest extent permitted by law. Except as required by New Zealand consumer law (e.g., the CGA) or any other applicable legislation, we will not be liable for any loss or damage that is not directly caused by a breach of these Terms by iGadget. To the maximum extent permitted by law, our total aggregate liability to you for any claim arising from your use of the website or purchase of products is limited to the amount you actually paid us for the relevant product(s) or service in question. This means that, if you bought a part from us and something went wrong that is our fault, the most we would owe you (aside from our obligations under law or any agreed remedy like a refund or replacement) would be no more than the price you paid for that part.

Furthermore, to the extent allowed by law, we will not be liable for any indirect, consequential, or special losses. This includes things like loss of profits, loss of business, loss of data, or other intangible losses that may result from using our products or our website. For example, if a part you bought from us fails and damages your device or causes you downtime, we’ll of course work with you on replacing/refunding the faulty part (as per warranty/CGA), but we would not be responsible for, say, the lost income you might have suffered or the cost of other unrelated repairs. We also are not responsible for any loss resulting from your improper use of the website or products (such as damage caused by attempting a repair without proper skills or tools, beyond what our warranty covers).

It’s important to note that nothing in this section or elsewhere in our Terms is intended to exclude or limit any legal rights you have that cannot be excluded or limited. In plain language: if the law says we’re responsible for something, then we are. In any areas where we are allowed to limit our liability, we’ve done so as stated above. If you ever have any issue with a product or our service, our goal is to fix the problem amicably and fairly. Please reach out to us and we will do our best to resolve it promptly.

Intellectual Property and Trademarks

All content on the iGadget website – including text, descriptions, product images, graphics, logos, button icons, and software – is the property of iGadget Limited or our content suppliers and is protected by intellectual property laws. You may electronically copy and print portions of our website solely for the purpose of placing an order or shopping with us. Any other use of our site content (such as reproduction, distribution, modification, or republication) without our prior written permission is strictly prohibited. You also may not use any meta tags or other hidden text utilizing our name or trademarks without our express consent.

Third-Party Brands: iGadget is an independent retailer of third-party replacement parts and accessories. We are not affiliated with or endorsed by the manufacturers of the devices for which we sell parts. Any brand names or trademarks (for example, Apple, Samsung, Huawei, Dell, etc.) that appear on our site are used only to identify the compatibility of our replacement parts or accessories with those branded devices. All such trademarks are the property of their respective owners. For instance, “Apple”, “iPhone”, “iPad”, and “MacBook” are trademarks of Apple Inc., and we use these terms solely to indicate that certain parts are suitable for use in Apple devices. This usage is nominative and does not imply any partnership or endorsement by the trademark owners. By using this website and purchasing parts, you acknowledge this trademark disclaimer. If you do not agree or understand this, please refrain from using our site.

Our own brand name “iGadget” and our logos are our trademarks. No license or permission is granted for their use by any third party. You must not use our trademarks in connection with any product or service without our prior written approval.

User-Generated Content: If our site allows for reviews, comments, or any user-generated content, any content you submit must not infringe on the IP rights of others or contain unlawful material. If there is any conflict between different pieces of information on our site, or between an order and these Terms, generally these Terms will prevail (unless explicitly stated otherwise in writing). As noted, in the case of conflicting information on the site itself, our official posted notices (like an announcement banner) override automated messages or general text.
  • Privacy: Your submission of personal information through the website or in the course of a transaction is governed by our Privacy Policy. We are committed to protecting your personal data in accordance with New Zealand’s privacy laws. Please review our Privacy Policy to understand how we collect, use, and share information. This includes, but is not limited to, acts of God, natural disasters, epidemics/pandemics, war or terrorism, labor strikes, shipping or supply chain disruptions, power or internet outages, or any other unforeseen events (“Force Majeure Events”). If such an event occurs that affects our ability to fulfill your order, we will inform you as soon as reasonably possible and do our best to minimize the impact.
  • Severability: If any provision of these Terms is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from these Terms. The remaining provisions will continue in full force and effect. Our failure to enforce any right or provision under these Terms shall not constitute a waiver of that provision or any other provision.
  • Assignment: You may not assign or transfer any rights or obligations under these Terms to any other person without our prior written consent. We may transfer our rights and obligations under these Terms to another party (for example, if there is a business sale or reorganization), but if we do so, we will ensure that your rights under these Terms are not reduced or compromised.

Governing Law and Dispute Resolution

These Terms and your use of the iGadget website (and any contracts for purchase of goods through the site) are governed by the laws of New Zealand. You agree that any dispute or claim arising out of or relating to these Terms, the website, or any purchase will be subject to the exclusive jurisdiction of the courts of New Zealand. By using this site or buying from us, you consent to New Zealand courts hearing any disputes (and you agree that New Zealand is a convenient forum for resolution).

If you are an overseas customer, please be aware that our products and services are tailored primarily for the New Zealand market and our site’s information may not be compliant with laws outside New Zealand. We make no representations that the content or products on this site are appropriate or available for use in other locations. If you choose to access or purchase from iGadget while outside New Zealand, you do so on your own initiative and are responsible for compliance with any local laws.

In the event of a dispute, we encourage you to contact us first to attempt to resolve the matter in good faith. We value our customers and will do our best to address any concerns without the need for legal proceedings.
